What is a Section 21 notice?

A Section 21 notice is a no-fault eviction notice. This means your landlord can ask you to leave even if you have done nothing wrong โ€” they do not need to give a reason. It is named after Section 21 of the Housing Act 1988. Once valid, you are required to leave by the date specified.

When can a landlord serve a Section 21?

A Section 21 cannot be served during the first 4 months of a new tenancy. It must give you at least 2 months notice. It cannot be used to evict a tenant who has complained about repairs or conditions โ€” this is called a retaliatory eviction and is illegal.

When is a Section 21 invalid?

A Section 21 is invalid if: your deposit was not protected in a government-approved scheme, you were not given the prescribed information about the deposit scheme, the property does not have a valid gas safety certificate or EPC, your landlord has not provided the How to Rent guide, or the property requires an HMO licence that the landlord does not have.

The Renters Reform Act and Section 21

The Renters Rights Bill, passing through Parliament in 2025, will abolish Section 21 no-fault evictions entirely. Once enacted, landlords will only be able to evict tenants using specific grounds under Section 8, such as rent arrears or wishing to sell the property. This is the biggest change to tenant rights in decades.

How to challenge a Section 21 notice

Check immediately whether any of the invalidity conditions above apply. If the deposit was not protected, or the gas safety certificate was not provided, the notice is invalid.
